By downloading, installing, accessing, or using LocalMedAI ("the Application"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not download, install, access, or use the Application.
The Application is intended solely for personal record-keeping and information organization. It is not a medical device and does not provide medical advice, diagnosis, or treatment. The summaries and PDFs generated are for your personal records only and are not a substitute for professional medical judgment.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use the Application for personal, individual, non-commercial purposes only.

By providing feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use your feedback without any obligation to compensate you.
The Application incorporates a derivative of Google's Gemma AI model. Your use of the Application is subject to both these Terms and Google's Gemma Terms of Use.
By using the Application, you agree to comply with the Gemma Terms of Use found at https://ai.google.dev/gemma/terms and the Gemma Prohibited Use Policy found at https://ai.google.dev/gemma/prohibited_use_policy, both of which are incorporated by reference into these Terms.
You must not use the Application (including its AI functionality):
Violation of the Gemma Terms of Use or Prohibited Use Policy constitutes a material breach of these Terms and may result in immediate termination of your right to use the Application without prior notice.
The Application is designed to process and store your documents and data locally on your device. We do not transmit your medical notes or personal records to our servers as part of normal operation.
Even though the provided app has a password protection and a powerful database encryption, you are solely responsible for securing your data (for example, choosing strong passwords, maintaining backups, restricting device access, and keeping your operating system up to date). We cannot recover your encrypted data if it is lost or corrupted.
When you request a download of the Application, you may be asked to provide your email address. By providing your email address you consent to receive product updates, support communications, and other information related to LocalMedAI. You may opt out of marketing communications at any time using the unsubscribe link included in our emails or by contacting us. Transactional and support messages may still be sent as they are necessary for providing the Application.

We may provide updates to the Application that fix bugs, improve features, or add new functionality. You agree that we may require you to install updates to continue using the Application.
By downloading and installing any update to the Application, you agree to be bound by these Terms and any amended Terms that accompany the update. If you do not accept an update or amended Terms, your sole remedy is to discontinue use of the Application.
Some updates may cause temporary disruption of functionality or loss of certain features. We may notify you of updates through in-app notifications and/or email communications.
Where applicable, mandatory local consumer protection rights shall apply and override any conflicting clause in these Terms. Nothing in these Terms affects those mandatory rights.
THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
Mandatory local consumer protection laws may limit or exclude the application of certain liability limitations in these Terms. Nothing in these Terms is intended to limit or exclude liability that cannot be limited or excluded under applicable law.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, LOSS OF PROFITS, LOSS OF GOODWILL, OR HEALTH-RELATED CONSEQUENCES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APPLICATION OR RELIANCE ON ITS OUTPUTS.
This limitation applies even if we have been advised of the possibility of such damages and regardless of the legal theory (contract, tort, negligence, product liability, or otherwise).
You agree to defend, indemnify, and hold us harmless from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the Application, your violation of these Terms, or your violation of any rights of another, except where such claims result from our breach of these Terms or applicable law.
We may terminate these Terms and your right to use the Application for material breach with reasonable notice where required by law. You may terminate at any time by discontinuing use and uninstalling the Application.
We reserve the right to modify these Terms. We will provide reasonable notice of material changes as described in Section 7.3. Continued use of the Application after such changes, or installation of an update as described in Section 7.2, will constitute your acceptance of the new Terms.
These Terms shall be governed by German law, except where mandatory local consumer protection laws provide otherwise.
If you are a consumer, you may bring legal proceedings in the courts of your country of residence where permitted by applicable law. EU consumers also have access to the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr/.
As a company based in Germany, we comply with the General Data Protection Regulation (GDPR). You have rights regarding personal data including access, rectification, erasure, restriction of processing, data portability, objection to processing, and withdrawal of consent.
